RE: World Intellectual Property Organization (WIPO) Case No. D2019-1711

The domain name ‹conciergeauctionscams.com› was transferred to luxury real estate firm Concierge Auctions after we filed a complaint under the Uniform Domain Name Dispute Resolution Policy that the website was false, deceptive, and defamatory. We successfully had the website taken down and appropriately transferred to Concierge Auctions. Excerpts from the Complaint are below, followed by the entirety of the complaint.

16. The ‹www.conciergeauctionscams.com› domain name (the “Domain Name”) was registered on September 6, 2018. Although Domains by Proxy is the registrant of record, we have strong evidence to show that the Domain Name is owned by Mr. Howard Appel or an entity associated with him. There is a website (the “Site”) found at the Domain Name. Mr. Appel previously operated a website found at ‹www.conciergeauctionlawsuits.com›. That website provided virtually the same content and links as the Site. That website clearly identified Mr. Appel as the operator of the Website (See Attachment E for screenshots of that site as of July 23, 2018. That website is no longer active and the domain name registration has lapsed.) Much of the content on the current Site was lifted from the prior website. Given this background, references to “Respondent” herein should be taken to refer to Mr. Appel and not the privacy/proxy service Domains by Proxy.

17. Mr. Appel is currently engaged in multiple litigations with Concierge Auctions relating to an unconsummated transaction. Mr. Appel has sued Concierge Auctions. He has sued Concierge Auctions' outside counsel personally, and he has sued the title company used by Concierge Auctions. This is discussed in more detail below.

18. Of even greater relevance to this matter, Mr. Appel is engaged in a coordinated campaign of social media and Internet disinformation, defamation, intimidation, and “fake news,” all intended to injure the business and reputation of Concierge Auctions and its officers. The Site is at the center of the coordinated campaign, which also uses Facebook posts, Twitter tweets and Medium “articles” to convey and amplify a web of misleading, false and damaging claims regarding Concierge Auctions, its personnel and its business.

25. The Respondent has registered and is using the Domain Name in bad faith. As set forth above, the domain name was registered primarily for the purpose of tarnishing the Domain Name and Complainant and attaining leverage over Complainant.

26. The website and the domain name are clearly intended to convey and does convey that Concierge Auctions is engaged in “scams” (i.e., some type of dishonest scheme, fraud, or swindle), which are seen as a particularly reprehensible type of illegal activity. This is both infringing, and false and defamatory.

48. Critically, there is not one court opinion finding any wrongdoing on the part of Complainant. Concierge Auctions hasn’t lost a single case. Indeed, there is not even a single case where allegations against Complainant have been adjudicated on the merits.
